SHOPIFY

Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you.

Your data is stored through Shopify’s data storage, databases and the general Shopify application. They store your data on a secure server behind a firewall.

PAYMENT

If you choose a direct payment gateway to complete your purchase, then Shopify stores your credit card data. It is encrypted through the Payment Card IndustryData Security Standard (PCI-DSS). Your purchase transaction data is stored only as long as is necessary to complete your purchase transaction. After that is complete, your purchase transaction information is deleted.

All direct payment gateways adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, Mastercard, American Express and Discover.

PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers.

For more insight, you may also want to read Shopify’s Terms of Service (https://www.shopify.com/legal/terms) or Privacy Statement (https://www.shopify.com/legal/privacy).

BUSINESS SALES OR TRANSFERS

In the event that our company or our Site is sold or transferred, or in the event that substantially all of our assets are sold or transferred to a third party, any personally identifiable information collected by us, will be among the transferred assets. By using the Site, you hereby agree to such transfer or assignment of this information.

LINKS

When you click on links on our store, they may direct you away from our site. We are not responsible for the privacy practices of other sites and encourage you to read their privacy statements.

DATA SECURITY

We use commercially reasonable security measures to safeguard your personally identifiable information in our possession against loss, theft and unauthorized use, disclosure or modification.

To protect your personal information, we take reasonable precautions and follow industry best practices to make sure it is not inappropriately lost, misused, accessed, disclosed, altered or destroyed.

If you provide us with your credit card information, the information is encrypted using secure socket layer technology (SSL) and stored with a AES-256 encryption. Although no method of transmission over the Internet or electronic storage is 100% secure, we follow all PCI-DSS requirements and implement additional generally accepted industry standards.

IF YOU DO NOT WISH TO PROVIDE PERSONAL INFORMATION

We do not require registration or submission of personally identifiable information to obtain basic access to the Site; however, you may not be able to access all areas and functions of the Site or purchase products or participate in activities.

CHILDREN’S PRIVACY

The Site complies with the Children’s Online Privacy Protection Act (COPPA). For more information about COPPA and children’s privacy, please visit http://www.ftc.gov/privacy/privacyinitiatives/childrens.html. When we use the term “parent” below, we mean to include legal guardians.

CHILDREN UNDER THE AGE OF 13

If you are under the age of 13, please be sure to read this Privacy Policy with your parent and ask questions about things you do not understand. Some areas of the Site may have special rules for children under the age of 13. When you are in those areas, you must follow those rules.

If a child under age 13 wants to use the Site for services or activities requiring registration, the only information we would collect from such child during our registration process is the child’s first name, parent’s e-mail address, child’s birth date, screen name, and password. We collect birth dates to validate the ages of our Site visitors and customers, including children. We do not collect any other personally identifiable information from children during our registration process. We may collect a child’s e-mail address from a parent for the purpose of sending the child e-mail related to the Site or services or activities. For example, we would send a Site newsletter to a child directly at the request of the child’s parent.

We send parents an e-mail requesting affirmative consent to the child’s participation when their child registers on the Site, registers for services and activities or enters a sweepstakes or contest. Before allowing a child under age 13 to participate in any such activity, we send an e-mail to the child’s parent requesting the parent’s affirmative consent to the child’s participation. If the parent gives such consent, we then follow that communication with an e-mail confirmation to the parent and allow the child to participate in the activity. If the parent refuses to allow the child’s participation, or if we do not hear back from the parent within 72 hours, the child’s personally identifiable information will be flagged for deletion from our database. Once a parent affirmatively permits a child to participate, the child will be able to participate in such services or activities without any further notification to the parent. If a child wins a sweepstakes or contest, we notify the parent at the parent’s e-mail address provided to us during the registration process, and the parent will have to mail or fax us a signed note at the address or fax number listed in the rules for the specific contest that says it was permissible for the child to enter, and tells us they will accept the prize for the child. We may publish a winner’s first name, first initial of last name, city, and state of residence on our Site.

CHILDREN BETWEEN THE AGES OF 13 AND 18

If you are between the ages of 13 and 18, please be sure to read this Privacy Policy with your parent and get his or her permission before you give us any of your personally identifiable information, before you participate in any activity or contest or before you buy anything from the Site. Do not post your real name on a web site or forum, and never tell anyone online anything private about yourself or your family, including your phone number and address. Use screen names at all times. If you win a sweepstakes that has a prize, your parent will have to mail or fax us a signed note at the address or fax number listed in the rules for the specific contest that says it was permissible for you to enter, and tells us they will accept the prize for you. Some areas of the Site may have special additional rules for children under the age of 18. When you are in those areas, you must follow those rules.

INFORMATION FOR PARENTS

Parents should regularly oversee their children’s use of e-mail and website participation. Control tools are available from online services and software manufacturers that can help provide a safe online environment for kids.

We do not require a child to disclose more information than is reasonably necessary to participate in an activity or service as a condition of participation. Parents may request a review and/or removal of their child’s information at any time by sending an e-mail to moc.snoitavonniainrofilac@ycavirp, which must include the same screen name, password, and e-mail address that their child submitted. To protect the child’s privacy and security, we will take commercially reasonable steps to verify the parent’s identity before granting him or her access to the child’s information.

TERMS AND CONDITIONS OF USE / NOTICE OF CHANGES

The terms of this Privacy Policy are incorporated into our general Terms and Conditions of Use. Please review our Terms and Conditions of Use. By using the Site, you signify your assent to this Privacy Policy. If you do not agree to this Privacy Policy, you are not authorized to use the Site. We reserve the right to make changes in this Privacy Policy, provided that we give notice to you of any such changes via e-mail and/or by posting the amended Privacy Policy on the Site. Please check back from time to time to ensure you are aware of any such notices of changes in our privacy practices. Your continued use of the Site will signify your acceptance of these changes.

If our store is acquired or merged with another company, your information may be transferred to the new owners so that we may continue to sell products to you.

California Privacy Notice (CCPA)

This section provides additional information for California residents under the California Consumer Privacy Act (CCPA). The terms used in this section have the same meaning as in the CCPA. This section does not apply to information that is not considered "personal information," such as anonymous, deidentified, or aggregated information, nor does it apply to publicly available information as defined in the CCPA.

To the extent we process deidentified personal information, we will make no attempt to reidentify such data.

Collection and Disclosure of Personal Information

The personal information we collect is described above in Information we collect. The personal information we disclose for business or commercial purposes is described above in How we disclose information. The length of time for which we retain personal information is described above in How long we keep your data. Our purposes for processing data are described above in Purposes of processing.

Information “Sharing” and “Selling”

We “share” certain personal information with third party ad networks for purposes of behavioral advertising, including: Commercial and Financial Information, Internet Activity, Online Identifiers, and Personal Identifiers. This allows us to show you ads that are more relevant to you.

We "sell" personal data to third parties, as that term is defined in the CCPA.

You may opt-out of these data practices here.

We do not knowingly sell or share (for cross-context behavioral advertising) the personal information of consumers under 16 years of age.

CCPA Rights

Your CCPA rights are described below. Make a Privacy Request by clicking here or the link at the top of this page or by emailing us at moc.snoitavonniainrofilac@ycavirp.

Right to Know and Access

You have the right to request to know and access the following about the personal information we have collected about you in the past 12 months:

  • the categories and specific pieces of personal information we have collected about you
  • the categories of sources from which we collect personal information about you
  • the business or commercial purposes for which we collect, sell, or share personal information
  • the categories of third parties with whom we disclose the information
  • the categories of personal information about you that we have sold, shared, or disclosed for a business purpose, and the categories of third parties to whom we have sold, shared, or disclosed that information for a business purpose

The information we would provide to you in response to a Request to Know Categories is contained in this Privacy Notice. To receive a copy of the specific personal information we have about you, submit a Request to Know or Access via the link above. If you make a Request to Know more than twice in a 12-month period, or we determine the request is manifestly unfounded or excessive, we may require you to pay a small fee for this service.

Right to Delete

You have the right to request that we delete any personal information about you that you have provided to us. Subject to certain limitations, we will delete from our records your requested personal information and direct our service providers to do the same.

Right to Non-Discrimination

If you exercise your CCPA consumer rights:

  • We will not deny goods or services to you
  • We will not charge you different prices or rates for goods or services, including through the use of discounts or other benefits or penalties
  • We will not provide a different level or quality of goods or services to you
  • We will not suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services
  • We will not retaliate against you, as an employee, applicant for employment, or independent contractor

We may still offer you certain financial incentives permitted by the CCPA such as discounts, rewards, premium features, or loyalty accounts that can result in different prices, rates, or quality levels.

Right to Opt-Out

You have the right to opt-out of any selling and sharing of your personal information.

You may exercise your right to opt-out here.

Right to Correct

You have the right to correct inaccuracies in your personal data, taking into account the nature of the data and our purposes for processing it.

Request Verification

Before we can respond to a Request to Know or Request to Delete, we will need to verify that you are the consumer who is the subject of the CCPA request. Verification is important for preventing fraudulent requests and identity theft. Requests to Opt-Out do not require verification.

Typically, identity verification will require you to confirm certain information about yourself based on information we have already collected. For example, we will ask you to verify that you have access to the email address we have on file for you. If we cannot verify your identity based on our records, we cannot fulfill your CCPA request. If you submit a request not through our webform, we will ask you to provide the same information requested in the webform.

For a request that seeks specific personal information, we ask that you sign a declaration stating that you are the consumer whose personal information is the subject of the request, as required by the CCPA.

In some cases, we may have no reasonable method by which we can verify a consumer's identity. For example:

  • If a consumer submits a request but we have not collected any personal information about that consumer, we cannot verify the request.
  • If the only data we have collected about a consumer is gathered through website cookies (i.e. the consumer visited our website but had no other interaction with us), we are unable to reasonably associate a requester with any data collected; therefore, we cannot verify the request.

Authorized Agent

A California resident's authorized agent may submit a rights request under the CCPA by emailing us at moc.snoitavonniainrofilac@ycavirp. Requests submitted by an authorized agent will still require verification of the consumer who is the subject of the request in accordance with the process described above. We will also ask for proof that the consumer who is the subject of the request authorized an agent to submit a privacy request on their behalf by either verifying their own identity with us directly or directly confirming with us that they provided the authorized agent permission to submit the request. An authorized agent that has power of attorney pursuant to California Probate Code section 4121 to 4130 may also submit proof of statutory power of attorney, which does not require separate consumer verification.

If you have trouble accessing this notice, please contact us at moc.snoitavonniainrofilac@ycavirp.
